Terms of Service

1. Eligibility and Accounts

You must be legally capable of agreeing to these Terms and must meet any minimum-age or parental-consent requirements that apply where you live. You agree to provide accurate account information, protect your credentials, and promptly tell us about suspected unauthorized use. You are responsible for activity under your account unless applicable law provides otherwise.

2. Permission to Use CruzN

Subject to these Terms, CruzN grants you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use the service for its intended personal and community purposes. CruzN and its software, design, branding, and content remain protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

3. Acceptable Use

You may not use CruzN to:

• Break traffic laws or facilitate speeding, street racing, reckless driving, distracted driving, trespassing, or other illegal conduct;
• Harass, threaten, defraud, stalk, impersonate, or harm another person;
• Post content that is unlawful, abusive, infringing, deceptive, or malicious;
• Gain unauthorized access to accounts, systems, data, or communications;
• Interfere with, reverse engineer, overload, scrape, or circumvent CruzN except where applicable law expressly permits it;
• Transmit malware or use automated systems in a way that harms the service or other users; or
• Use another person's location or personal information for an unauthorized or harmful purpose.

We may investigate suspected misuse and restrict content, features, or accounts when reasonably necessary to protect CruzN, its users, or the public.

4. User Content and Community Features

You retain ownership of content you submit. You grant CruzN a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process that content only as reasonably needed to operate, improve, secure, and promote the features in which you chose to share it. You represent that you have the rights needed to submit your content.

Profiles, crews, chats, routes, cruises, meetups, and other community material may be created by users. CruzN does not endorse or guarantee user content and is not responsible for another user's conduct. Use judgment before meeting or sharing information with people you do not know.

5. Driving, Routes, and Location

The Driver Safety Agreement is incorporated into these Terms. Do not operate or interact with CruzN while driving. Use a passenger or safely park in a lawful location before interacting with the app.

Maps, routes, locations, estimated paths, alerts, and user-provided information may be delayed, incomplete, inaccurate, unavailable, unsafe, or inconsistent with current road conditions. Always obey the law, posted signs, law-enforcement instructions, and actual road conditions. You remain solely responsible for vehicle operation, insurance, licensing, vehicle condition, route decisions, and participation in any activity.

6. User-Organized Activities

Unless expressly identified otherwise, cruises, crews, meets, destinations, events, and routes on CruzN are organized by users, not CruzN. We do not supervise participants or guarantee the safety, legality, identity, reliability, conduct, attendance, or suitability of an activity. Participation is voluntary and at your own risk.

7. Virtual Items, Reputation, and Rewards

CruzN may provide virtual cars, currency, reputation, badges, missions, upgrades, or other digital items. Unless expressly stated otherwise, these items are licensed features, have no cash value, are not property, cannot be redeemed for money, and may not be transferred or sold outside CruzN. We may adjust availability, balance, requirements, or progression to operate and improve the service, subject to applicable law.

8. Purchases

Some features or virtual items may be offered for purchase through Stripe or another displayed payment provider. Prices, taxes, included items, and any specific purchase terms will be shown at checkout. Payments are also governed by the provider's terms. Except where required by law or expressly stated at purchase, completed purchases are final. Contact support@ibyde.com with a purchase issue.

9. Third-Party Services

CruzN relies on or may link to third-party services, including authentication, hosting, maps, routing, place search, peer-to-peer communication, and payment providers. Their services and content may be governed by separate terms and privacy policies. CruzN is not responsible for a third party's independent services, availability, or conduct.

10. Availability and Changes

CruzN may add, change, suspend, or discontinue features. We aim to keep the service available, but do not promise uninterrupted, error-free, or permanent access. Maintenance, network failures, third-party outages, security events, or other circumstances may affect availability.

11. Suspension and Termination

You may stop using CruzN at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or safety risk, harmed other users, or misused the service. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, limitations, and dispute-related provisions.

12. Disclaimers

To the fullest extent permitted by law, CruzN is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant routes, user content, user conduct, safety, availability, accuracy, or results. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by applicable law, CruzN and its owners, developers, operators, affiliates, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, use, property, or personal injury arising from or related to CruzN, user conduct, driving, routes, cruises, meets, or other activities.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. The separate limitations and acknowledgments in the Driver Safety Agreement also apply.

14. Applicable Law and Disputes

These Terms are governed by applicable law, without overriding any mandatory consumer protection that applies to you. Before filing a formal claim, you agree to contact us and make a good-faith effort to resolve the concern informally, except where doing so is not required or permitted by law.

15. Changes to These Terms

We may revise these Terms as CruzN changes. We will update the effective date and provide additional notice when required. If you continue to use CruzN after revised Terms take effect, you agree to the revised Terms.
